The Public Protector is one of the six state institutions supporting constitutional democracy established under section 181 of the Constitution, and is independent and subject only to the Constitution and the law.
Section 182 empowers it to investigate any conduct in state affairs, or in the public administration in any sphere of government, that is alleged or suspected to be improper or to result in any impropriety or prejudice; to report on that conduct; and to take appropriate remedial action. Its remedial action is binding unless set aside by a court, as confirmed by the Constitutional Court.
It investigates maladministration, abuse of power, improper enrichment and undue delay, and its services are free and available to anyone. The Executive Members’ Ethics Act also makes it responsible for investigating alleged breaches of the executive ethics code.
