Road Accident Fund (RAF)

The Road Accident Fund provides compulsory cover to all users of South African roads against loss or damage resulting from bodily injury or death caused by the negligent driving of a motor vehicle. It operates under the Road Accident Fund Act, 1996 (Act No. 56 of 1996).
It is funded by a dedicated levy on every litre of petrol and diesel sold, rather than by insurance premiums, and it compensates claimants for medical expenses, loss of earnings, loss of support and general damages. In return, the Act limits the right of an injured party to claim directly from the negligent driver.
The fund carries a large actuarial liability for claims incurred but not yet settled, and reform proposals have included moving from a fault-based compensation model to a defined benefit structure. It reports to the Department of Transport.
