Commission on Restitution of Land Rights

Judicial Institution · Economic Infrastructure and Development · reports to Department of Land Reform and Rural Development (DLRRD)

The Commission on Restitution of Land Rights investigates and settles claims for the restitution of land rights lost as a result of past racially discriminatory laws and practices. It is established under the Restitution of Land Rights Act, 1994 (Act No. 22 of 1994), which gives effect to section 25(7) of the Constitution.

A person or community dispossessed of rights in land after 19 June 1913 as a result of racially discriminatory laws is entitled to restitution of that property or to equitable redress. The Commission receives and investigates claims, attempts to settle them by negotiation, and refers unresolved matters to the Land Claims Court.

It is headed by the Chief Land Claims Commissioner and operates through regional land claims commissioners. Settlement may take the form of restoration of the land itself, alternative land, financial compensation, or a combination of these.
