The Community Schemes Ombud Service resolves disputes in community schemes and regulates their governance documents. It was established under the Community Schemes Ombud Service Act, 2011 (Act No. 9 of 2011).
Community schemes include sectional title developments, share block companies, homeowners’ associations, housing schemes for retired persons and housing co-operatives. The Service provides a dispute resolution process for owners and occupiers as an accessible alternative to litigation.
It takes and determines disputes about levies, conduct rules, maintenance, meetings and governance, and its adjudication orders are enforceable as if they were court orders. It also approves scheme governance documentation and holds scheme annual financial statements. It reports to the Department of Human Settlements.
