The Constitutional Court, seated in Braamfontein, Johannesburg, is the highest court in South Africa. It consists of the Chief Justice, the Deputy Chief Justice and nine other judges, and hears most matters as a full bench.
Since the Constitution Seventeenth Amendment Act came into force in 2013 it is the apex court in all matters, not only constitutional ones, and may decide any matter that raises an arguable point of law of general public importance. It has exclusive jurisdiction over certain questions, including disputes between organs of state in the national or provincial sphere, the constitutionality of a Bill referred to it, and whether Parliament or the President has failed to fulfil a constitutional obligation.
An order of invalidity made by the Supreme Court of Appeal, the High Court or a court of similar status against an Act of Parliament, a provincial Act or the conduct of the President has no force unless the Constitutional Court confirms it.
