The Education Labour Relations Council is the bargaining council for the public education sector. It operates under the Labour Relations Act, 1995.

It provides the forum in which the employer, represented by the state, and the recognised teacher unions negotiate conditions of service, salaries and workplace matters for public school educators. Collective agreements concluded in the Council bind the sector.

It also provides dispute resolution for the sector, conciliating and arbitrating disputes between educators and their employer, including disciplinary and unfair labour practice matters. Its arbitration function operates in place of the CCMA for the education sector.
