The Electoral Commission is the independent body responsible for managing elections in South Africa, established under section 181 of the Constitution as one of the six state institutions supporting constitutional democracy.
Section 190 requires it to manage elections for national, provincial and municipal legislative bodies, to ensure that those elections are free and fair, and to declare the results within the period prescribed by national legislation. It compiles and maintains the national common voters’ roll and the register of political parties.
Its wider work includes voter registration and education, party liaison committees at national, provincial and municipal level, the accreditation of observers, and the administration of party funding disclosure under the Political Party Funding Act. The Constitutional Court has confirmed that independent candidates may contest national and provincial elections, a change first given effect in the 2024 general election.
