The Financial and Fiscal Commission is an independent advisory institution established under Chapter 13 of the Constitution, in sections 220 to 222. It is subject only to the Constitution and the law and must be impartial.
Its function is to make recommendations to Parliament, the provincial legislatures and any other authority determined by national legislation on financial and fiscal matters, in particular the equitable division of nationally raised revenue among the national, provincial and local spheres of government.
The Constitution and the Intergovernmental Fiscal Relations Act require that its recommendations be considered before the division of revenue is enacted each year, and government must report on the extent to which it has taken them into account. Its work also covers provincial and municipal borrowing, conditional grants and the fiscal framework for local government.
