Independent Police Investigative Directorate (IPID)
National Department · Justice and Protection Services · reports to Department of Police (SAPS)
The Independent Police Investigative Directorate investigates offences allegedly committed by members of the South African Police Service and the municipal police services. It gives effect to section 206(6) of the Constitution and operates under the Independent Police Investigative Directorate Act, 2011 (Act No. 1 of 2011), which replaced the former Independent Complaints Directorate.
Certain matters must be reported to it and investigated: deaths in police custody and as a result of police action, complaints of the discharge of an official firearm, rape by a police officer or of a person in police custody, torture or assault, and corruption matters referred to it.
It makes recommendations to the National Prosecuting Authority on criminal prosecution and to the police service on disciplinary steps, and the police are obliged to report back on the action taken. The Constitutional Court has ruled on the legislative protections needed to secure its independence.
