The National Prosecuting Authority is the single national prosecuting authority established under section 179 of the Constitution and the National Prosecuting Authority Act, 1998 (Act No. 32 of 1998). It has the power to institute criminal proceedings on behalf of the state and to carry out any necessary functions incidental to that.
It is headed by the National Director of Public Prosecutions, appointed by the President, and must exercise its functions without fear, favour or prejudice. Directors of Public Prosecutions lead prosecutions in each High Court jurisdiction.
Specialised units within it include the Investigating Directorate Against Corruption, which handles serious corruption and state capture matters, the Asset Forfeiture Unit, which recovers the proceeds of crime under the Prevention of Organised Crime Act, the Specialised Commercial Crime Unit, the Sexual Offences and Community Affairs Unit, and the Priority Crimes Litigation Unit.
