The Office of the Pension Funds Adjudicator resolves complaints against retirement funds. It operates under the Pension Funds Act, 1956 (Act No. 24 of 1956).
It investigates and determines complaints by members, former members and beneficiaries about the administration of a fund, the investment of its assets, or the interpretation and application of its rules. Its service is free to complainants.
A large share of its caseload concerns employers who deduct pension contributions from employees’ salaries but fail to pay them over to the fund, and the distribution of death benefits under section 37C. Its determinations have the effect of a civil court judgment and may be enforced accordingly.
