The Road Traffic Infringement Agency administers the administrative adjudication of road traffic offences. It was established under the Administrative Adjudication of Road Traffic Offences Act, 1998 (Act No. 46 of 1998).
The Act creates a system in which most traffic infringements are dealt with administratively rather than through the criminal courts, with a points demerit system attached to driving licences. The Agency processes infringement notices, administers representations and elections to be tried in court, and manages the enforcement orders that follow unpaid penalties.
It also runs road safety awareness programmes. Implementation of the demerit system has been repeatedly delayed and subject to constitutional litigation. It reports to the Department of Transport.
