Special Investigating Unit (SIU)

The Special Investigating Unit investigates corruption, maladministration and malpractice in state institutions and recovers losses suffered by the state. It operates under the Special Investigating Units and Special Tribunals Act, 1996 (Act No. 74 of 1996).

It may only investigate matters referred to it by the President through a published proclamation, which defines the scope of each investigation. Its powers include search and seizure, subpoena and interrogation under oath.

Distinctively, it can institute civil proceedings to recover money or set aside unlawful contracts, and since 2019 it has been able to bring those matters before the Special Tribunal, a dedicated court that hears civil recovery claims arising from its investigations. Its findings may also be referred to the National Prosecuting Authority for criminal prosecution and to institutions for disciplinary action.
