The Supreme Court of Appeal, seated in Bloemfontein, is the second highest court in South Africa. It consists of the President and Deputy President of the Court and a number of judges of appeal, and normally hears matters in panels of five.
It functions only as a court of appeal and may decide appeals in any matter arising from the High Court or a court of similar status, except in respect of labour or competition matters to the extent that other legislation provides otherwise. It has no jurisdiction of first instance.
Its decisions bind all courts below it, and appeals from it lie to the Constitutional Court. Established in 1910 as the Appellate Division of the Supreme Court of South Africa, it was renamed and reconstituted under the 1996 Constitution.
