The CCMA resolves labour disputes. It was established under the Labour Relations Act, 1995 (Act No. 66 of 1995), and is independent of government, political parties, trade unions and employers.
Its core function is conciliation, and where that fails, arbitration of disputes including unfair dismissal, unfair labour practice, discrimination and wage disputes. Its services are free to users and no legal representation is required, which makes it accessible to workers who could not otherwise pursue a claim.
It also facilitates workplace restructuring under section 189A, certifies the outcome of disputes, accredits bargaining councils and private agencies, and provides training on labour law.
