Companies Tribunal
Public Entity · Economic Infrastructure and Development · reports to Department of Trade, Industry and Competition (the dtic)
The Companies Tribunal adjudicates applications and disputes under the Companies Act, 2008 (Act No. 71 of 2008).
It provides an accessible alternative to the High Court for a defined set of company law matters. Its jurisdiction includes company name disputes, applications for exemption from the requirement to appoint a social and ethics committee, applications to extend the time for holding an annual general meeting, and reviews of certain decisions of the Companies and Intellectual Property Commission.
It also offers voluntary alternative dispute resolution in company disputes. Its proceedings are designed to be faster and less costly than litigation, and applicants may appear without legal representation.
