The Competition Commission investigates and prosecutes anti-competitive conduct and evaluates mergers. It was established under the Competition Act, 1998 (Act No. 89 of 1998).
It investigates restrictive horizontal and vertical practices, including cartels and price fixing, and abuse of dominance by firms with market power. It reviews merger notifications, approving small and intermediate mergers itself and referring large mergers to the Competition Tribunal with a recommendation.
It also conducts market inquiries into sectors where competition may be impeded, having examined private healthcare, data services, grocery retail and online platforms. Its corporate leniency policy offers immunity to the first cartel member to come forward.
