The Competition Tribunal adjudicates competition matters in South Africa. It was established under the Competition Act, 1998 (Act No. 89 of 1998), and functions as a specialist court of first instance for competition law.
It hears and decides cases referred to it by the Competition Commission, including prohibited practice complaints and large merger notifications. It may impose administrative penalties for prohibited conduct, approve mergers with or without conditions, and prohibit them outright.
It is independent of the Commission, which performs the investigative and prosecutorial role, preserving the separation between investigation and adjudication. Its decisions may be appealed to the Competition Appeal Court.
