The Department of Justice and Constitutional Development administers South Africa’s courts and the legal framework that supports them, and promotes constitutional development and human rights.

It provides the administrative and financial support that allows the judiciary to function, manages the Master of the High Court, the State Attorney and the Legal Aid system, and develops legislation across the justice portfolio. It also supports the constitutional institutions established under Chapter 9.

Correctional Services was separated into its own department after the 2024 election. The National Prosecuting Authority, the Special Investigating Unit, Legal Aid South Africa and the South African Human Rights Commission fall within the wider justice cluster.
