The Department of Mineral and Petroleum Resources regulates South Africa’s mining and upstream petroleum industries and promotes their contribution to the economy.
It took its current form in 2024, when the energy functions of the former Department of Mineral Resources and Energy moved to the new Department of Electricity and Energy, leaving mineral and petroleum resources as a standalone portfolio.
Under the Mineral and Petroleum Resources Development Act, 2002 (Act No. 28 of 2002), mineral and petroleum resources are the common heritage of all South Africans, with the state as custodian. The department grants prospecting and mining rights and exploration and production rights, regulates mine health and safety, and oversees mine environmental management and rehabilitation. The Council for Geoscience, Mintek, the Council for Mineral Technology and the South African Diamond and Precious Metals Regulator report to it.
